High Court lifts ban on sale of tobacco products in Delhi, know what it said

People engaged in tobacco business for years had approached the High Court against the Delhi government’s notifications.

Delhi News: The Delhi High Court has quashed the Food Safety Commissioner’s notification prohibiting the manufacture, storage and sale of gutkha, pan masala, tobacco and other such products in the national capital. These notifications were issued between 2015 and 2021. After this decision of the court, the ban on manufacturing and selling tobacco-related products in Delhi will be lifted.

At the same time, the court also condemned the use of tobacco products. The court said that it is conscious of the harmful effects and various diseases caused by the use of tobacco. Both non-smoking and non-smoking are injurious to public health. The court said that it condemns the use of any form of tobacco. But, the question of law cannot be decided only on the basis of public consciousness and sentiments and must be decided on the basis of fair interpretation of law.

Justice Gaurang Kanth said, “Unquestionably, the Court is of the opinion that tobacco and nicotine are injurious to health. However, there are certain statutory questions of law in the present case, which cannot be decided only on the basis of public consciousness and sentiments, but have to be decided on the basis of proper interpretation.”

Let us inform that for years, people engaged in tobacco business had approached the High Court against the notifications of the Delhi Government, on which the High Court has given this decision during the hearing. The petitioners had challenged various notifications issued by the Commissioner of Food Safety, Delhi government, prohibiting the manufacture, storage, distribution or sale of gutka, pan masala, flavored tobacco in the national capital.

Tobacco cannot be considered as food

The court said that tobacco cannot be treated as ‘food’ under the Food Safety and Security Act. Both FSSA and COTPA Act are for different sectors. FSSA applies to the food industry whereas COTPA to the tobacco industry, so the provisions of COTPA cannot be repealed by the FSSA.
