Jolt to Rahul Gandhi, High Court dismisses review petition

During a rally in Karnataka during the 2019 Lok Sabha elections, Rahul Gandhi made a statement regarding the ‘Modi surname’. The court has convicted him in this case.

In the Modi surname case, Rahul Gandhi has got a big blow from the Gujarat High Court. Rahul Gandhi appealed in the High Court against the decision of the Surat Sessions Court. The High Court has rejected his petition. In the Modi surname case, on March 23, 2023, the Surat Sessions Court convicted Rahul Gandhi and sentenced him to 2 years. Rahul Gandhi’s parliamentary membership was canceled the very next day. Against this decision, on 25 April 2023, a review petition was filed in the Gujarat High Court on behalf of Rahul Gandhi. Whose decision was secured by the Gujarat High Court on 2 May. Today the verdict has been heard in the same case.

What is the whole matter?

In 2019, while giving a speech at an election rally in Kolar, Karnataka, Rahul Gandhi had said why all thieves have Modi as their surname. Rahul Gandhi said that “Why is the surname of Nirav Modi, Lalit Modi, Narendra Modi common? Why is the surname of all thieves Modi? After this Gujarat BJP MLA and former minister Purnesh Modi filed a petition against it in Surat Sessions Court. In this case, the Surat court convicted Rahul Gandhi in the defamation case and sentenced him to 2 years.

After this, Rahul’s membership of Parliament was canceled by the Lok Sabha Secretariat under the Representation of the People Act. Rahul was an MP from Wayanad in Kerala. According to this law, if any MP and MLA is punished for 2 years or more in any case, then their membership (from Parliament and Legislative Assembly) is cancelled. Not only this, under this law, there is a ban on contesting elections for 6 years.
