In this case, after the decision of the lower court, Rahul Gandhi’s parliament membership was cancelled.
Congress demands early hearing
The Congress demanded an early hearing of the matter from the CJI’s bench. Earlier, the petition filed by the Congress stated that ‘Modi’ is an undefined group which has no shape. Its about 13 crore people live in different parts of the country and they belong to different communities. On the other hand, the offense of defamation under section 499/500 of the Indian Penal Code is considered only in relation to a defined group. It states that the word ‘Modi’ does not fall under any category of association or collection of persons under Section 499 of the IPC.
It has been said in Rahul Gandhi’s petition that if the petitioner is not given relief in this matter, then eight years of his career will be wasted. Explain that a person convicted of any offense under Section 8(3) of the Representation of the People Act and sentenced to two years imprisonment will be ineligible to contest elections for the next six years even after serving the jail term and sentence. . In this way, he will have to stay away from politics for a total of 8 years. If Rahul Gandhi does not get relief from the Supreme Court, then he will not be able to contest the 2024 Lok Sabha elections.
What is the whole matter?
During an election rally in 2019, Rahul Gandhi had commented on the Modi surname. At a rally in Karnataka’s Kolar, Rahul Gandhi had said- “How come all thieves have Modi as their surname?” Regarding this, BJP MLA and former Gujarat minister Purnesh Modi had filed a defamation case against Rahul Gandhi. In this case, on March 23, the CJM court of Surat sentenced Rahul to two years. However, the court had given 30 days to implement the decision.
