Shock to Rahul Gandhi for revealing identity of minor rape victim, Delhi High Court seeks reply from NCPCR

The National Commission for Protection of Child Rights has been given four weeks time to file a counter affidavit.

The Delhi High Court has sent a notice to the National Child Rights Panel seeking its reply in a case involving Congress leader Rahul Gandhi. A petition was filed against Rahul Gandhi in connection with a tweet revealing the identity of relatives of a rape and murder victim in 2021. Now a reply has been sought from NCPCR regarding this petition.

A bench of Chief Justice Satish Chandra Sharma and Justice Sachin Datta issued notice to the National Commission for Protection of Child Rights and gave four weeks time to file a counter affidavit in response to the petition.

The court listed the matter for further hearing on July 27. At the outset, the counsel for NCPCR submitted that a formal notice has not been issued to them. Also urged the court to issue notice to the child rights body on the petition, so that it can file an affidavit.

The Crime Act 2012 prohibits the disclosure of the identity of minor victims of sexual offences.

The NCPCR had earlier told the court that despite Twitter’s claim that it had removed Rahul Gandhi’s alleged tweet, the offense of disclosing it remained. The lawyer for Twitter had also pointed out that initially the entire account of Rahul Gandhi was suspended by the social media platform, but was later reinstated.

On 1 August 2021, a nine-year-old Dalit girl died under suspicious circumstances. Her parents alleged that she was raped by the priest of a cremation ground in southwest Delhi’s Old Nangal village, and then murdered and cremated. On 5 October 2021, the then Chief Justice D.N. A bench headed by Patel issued notice to Twitter on a plea alleging that Rahul Gandhi was trying to take political advantage out of the unfortunate incident.
