About 48 years ago, on the morning of June 12, 1975, in court room number 24 of the Allahabad High Court, Justice Jagmohan Sinha, while giving a historic verdict, said, ‘Indira Gandhi has been found guilty of rigging the elections held in Rae Bareli. His election is cancelled. After Justice Sinha’s decision, Indira Gandhi was disqualified from contesting elections for the next 6 years under the Representation of the People Act. According to the decision of the High Court, Indira Gandhi had misused government machinery and resources during the elections. That’s why his election as MP was considered illegal. The court had given three weeks’ time to the Congress party to make a ‘new system’ as an immediate relief.

Famous lawyer Shanti Bhushan, who argued on behalf of Rajnarayan, had told a magazine that on March 18, 1975, Indira Gandhi had to answer questions related to her election in the court for about 5 hours. Justice Sinha acquitted Indira Gandhi on 5 of the seven charges leveled against her in Rajnarayan’s petition, but found her guilty on 2 counts. Senior journalist Kuldeep Nayyar has mentioned in one of his books that after 11 days on 23 June 1975, Indira Gandhi challenged this decision in the Supreme Court.
