Law may be brought regarding marriage of NRIs with Indian citizens, Law Commission made this recommendation

The Law Commission has recommended making a law regarding Indian marriage of NRIs. The Law Commission said that fraud is taking place in marriage cases between NRIs and Indian citizens and this is very worrying. According to the Law Commission, registration of marriages between NRIs and Indian citizens should be made mandatory.

Law Commission Chairman Justice (retd) Ruturaj Awasthi has submitted a report titled Law on Matrimonial Issues Relating to Marriages between NRIs and Indian Citizens to the Law Ministry. According to the report, the Commission wants the proposed law to ensure registration of NRIs and Overseas Citizen of India (OCI) with Indian citizens to cover all aspects of marriage.

Rituraj Awasthi, in his letter to Law Minister Arjunram Meghwal on Thursday, said, “The increasing cases of fraud in marriages between NRIs and Indian citizens is worrying. Many reports highlight this where these marriages are proven to be fraudulent. “These marriages leave Indian spouses, especially women, in uncertain situations.”

The Commission said such a law should be applicable not only to NRIs but also to people with Overseas Citizens of Indian Origin (OCI) status. “It has also been recommended that all marriages between NRIs/OCIs and Indian citizens should be compulsorily registered in India,” Rituraj Awasthi said.

The proposed law also seeks to include provisions for divorce, spousal maintenance, maintenance of children, summons, warrants or judicial documents to NRIs and OCIs. Justice Awasthi said in the letter, “Required amendments to be made in the Passport Act, 1967 to make it mandatory for declaration of marital status, linking of passports of husband and wife with each other and presence of marriage registration number on the passports of both.” Needed.”
